Carl Millar was instructed by Ms VJ who faced disqualification for a minimum period of six months under the totting up provisions.

Ms VJ received 4 penalty points for speeding, which took her to 13 penalty points on her driving licence.  Carl Millar advanced exceptional hardship at Kidderminster Magistrates Court and persuaded the Magistrates to not disqualify Ms VJ at all.  The Court accepted that she had only recently set up her business in the healthcare profession and that the nature of her business relied upon her ability to use a car as a mode of transport in order to succeed.  They accepted that it was likely that the company would fall into liquidation and she would then not have an ability to pay her mortgage and could face repossession proceedings.  Another successful case before Kidderminster Magistrates Court.
