Place: Kidderminster Magistrates Court

Offence: Speeding in excess of 100mph

Defence: Mitigation

Mr W was very concerned about being disqualified from driving as he was travelling in excess of 100mph.

The Magistrates Court Sentencing Guidelines suggest a period of disqualification of up to 56 days.

Mitigation was advanced at Court on behalf of Mr W, who was concerned about losing his job and the impact upon his family, as he would not have been able to maintain his mortgage payments.

The argument was accepted by the Court and Mr W received penalty points instead of a driving disqualification.  Naturally, Mr W was delighted in the circumstances.
