Offence: Speeding – Totting up 12 penalty points on driving licence

Carl Millar represented Mr I before Chorley Magistrates Court.  Mr I was

travelling at 71mph in a 40mph speed restriction area.  Unfortunately, Mr I already had 9 penalty

points on his driving licence.  The imposition of a further 3 penalty points would have resulted in Mr

I facing a minimum period of disqualification of 6 months under the totting up provisions.

Carl Millar was able to persuade the Court to disqualify Mr I for the offence alone rather than the

imposition of penalty points and therefore avoiding the possibility of a six month disqualification

period.  Mr I received a 3 week disqualification and he was delighted with the outcome.
