Place: Banbury Magistrates Court

Offence: Speeding – Totting up 12 penalty points

Defence: Exceptional Hardship

Millars Solicitors represented Mr W before Banbury Magistrates Court on the 29th January 2019.  He had accumulated 12 penalty points on his driving licence and he therefore faced a minimum period of disqualification of 6 months.  Millars Solicitors successfully advanced mitigation to persuade the Magistrates to disqualify Mr W for the offence of speeding outright, rather than the imposition of penalty points, which would have made Mr W a “totter”.  The Magistrates accepted the argument and Mr W received a 3 week driving disqualification instead of receiving a six month driving disqualification under the totting up provisions.  Naturally, Mr W was delighted with the outcome.
