Offence: Driving with Excess Alcohol / Drink Driving

Carl Millar was instructed by Mr M in relation to an allegation of driving with excess alcohol.  Mr M had a relatively high reading in alcohol, of 82µg in 100ml of breath.  Magistrates Court Sentencing Guidelines would suggest a period of disqualification of 22 months in the circumstances.  The case was further aggravated by the fact that Mr M had passengers in his vehicle at the time of the incident.

Powerful mitigation was prepared by Millars Solicitors and the Court accepted the strong argument presented and disqualified Mr M for the minimum period of 12 months.  Mr M was also offered the Drink Drivers Rehabilitation Course and successful completion of the course will reduce the disqualification period down to 9 months.  Naturally, Mr M was delighted with the outcome as he feared being disqualified for at least 22 months and the actual disqualification would be for 9 months upon successful completion of the Drink Drivers Rehabilitation Course.
