Place: Carlisle Magistrates Court

Offence: Speeding / Totting Up 12 penalty points on driving licence

Defence: Exceptional Hardship

Carl Millar represented Mr H before Carlisle Magistrates Court.

Mr H had accumulated 12 penalty points on his driving licence due to a series of speeding matters.

Mr H was very concerned about being disqualified from driving for the minimum period of six months.  This would have resulted in the loss of his job and the collateral damage would mean that he would no longer be able to maintain his mortgage payments.

Mr H was also concerned about obtaining gainful employment after the driving disqualification ended as he was near retirement age.  The Court also considered the impact upon Mr H’s wife as she would also face being made homeless through no fault of her own.

The Court accepted the argument presented by Carl Millar and exercised their discretion to not disqualify Mr H in the circumstances.

Offence: Speeding – in excess of 100mph

Defence: Mitigation

LATEST VICTORY – DISQUALIFICATION AVOIDED WHEN DRIVING AT 104MPH

Millars Solicitors represented Mr G who appeared before Bodmin Magistrates Court on the 6th March 2019.

Mr G was very concerned about being disqualified from driving and realised that he could be disqualified for a period of up to 56 days in accordance with the Magistrates Court Sentencing Guidelines.  Mr G did have powerful mitigation and was concerned about the impact of any disqualification upon his son.

The argument was advanced at Court that hardship would be caused, not only to Mr G but to his family and particularly his son.

The Court accepted the argument and imposed penalty points instead of a driving disqualification.

Carl Millar from Keep My Driving Licence, part of Millars Solicitors represented Mr M before Lincoln Magistrates Court on 21st January 2019. Mr M was speeding whereby he was travelling at 92mph in a 60mph speed restriction area. In the circumstances Mr M faced a disqualification of up to 56 days. Millars Solicitors successfully persuaded the Court to impose 6 penalty points instead of a driving disqualification. Any period of disqualification would have caused Mr M exceptional hardship. The magistrates before Lincoln Magistrates Court accepted the argument put forward by Millars Solicitors.
